Navigating the Shops and Establishments Act: What Registers and Requirements Do We Need?

Hi HR friends,

Our organization is in the healthcare segment situated in Bangalore and registered under the Companies Act. I suppose we also need to be registered under the Shops and Commercial Establishments Act, 1961. What are the registers to be maintained apart from attendance and visitors' book? What are the other statutory requirements? As I am new to the service sector, your kind assistance and guidance are highly appreciated.

Dear Mr. AHN,

The Shops & Establishment Act falls under Labour Acts. You have to obtain registration from the Labour Department (depending on your employee strength, the concerned labour officer will issue the Registration Certificate). At that time, you should submit the Payment Challan, Form I, Article of Memorandum (under Companies Act Registration), and a list of employees.

All these documents have to be submitted to your labour officer for the issuance of the labour license under the Shops & Establishment Act.

Can you please tell me what is the format of the employees' attendance register prescribed under the Shops and Establishments Act? We plan to replace the manual muster with electronic attendance tracking. What are the headings that we need to capture so that we can get an exemption?
