How To Tackle

Dear Guys,
I am working as HR Executive in a Private sector, we have a problem that in HR Policy, It was implemented only few months before (wef May 08), there we have included leave structure as 6 CL,4 SL totally 10 days as an average of this year from May. Many of the employees is in Probation Period, We have given more leaves for all those emplyees including the employees who are all in probation period. Our top mgmt asked that y did u give more leaves to all employees, they said no leave for new joinees, In our HR policy there s no words, leaves are only applicaple specifically to permanent employees. Hope U may understand my situtation.
Please advise me wat shall i do?

Hi Saravanan,
You have to understand that the employees in probation are not entitled to certain employee benefits like leaves, LTA, Mediclaim(not Hospitalization benefits).
Even though they are considered as the employees they are still in probation and they do not falll under the complete governance of Labor Law. Hence certain legal benefits are not applicable to probationary employees.. If u have included such benefits like leave as u mentioned in ur query it is better that u remove them as soon as possible to avoid further complications form ur higher authorities.... Try to communicate the same point to ur employees so that they can understand u..

Hi Saravanan,
During the First year of service, An Employee is eligible only for the CL and SL, that too on prorata basis. And this can be achieved only when you keep track of the leaves taken by all the employees on monthly basis.
Earned Leaves are only applicable after the completion of One year of service of the employee with the Company.
