Are There Legal Guidelines for Moving Contract Workers Between States? Seeking Clarity

Dear all,

We are a company involved in the supply of contract labor for various industries across all sectors. Based on requirements, we deploy labor from one state to another (i.e., if labor is needed in Tamil Nadu at a particular place and sufficient labor is not available, then labor from neighboring states is deployed).

We would like to know if there are any laws/rules governing such inter-state deployment (migration of labor) either in the Contract Labor Act or any other labor rules. I request clarification/information from our learned forum members. Kindly clarify this aspect.

Dear Friend,

The Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979 is an Act to regulate the employment of inter-State migrant workmen and to provide for their conditions of service and for matters connected therewith.

So you have to take registration under this Act before employing workers from other states.

Can anybody help?

One of our contractors has a labor license for 50 people and an interstate migration license for 25 people. Can we allow him to deploy more labor than 50 people, or do I have to ask him to amend the labor license for the excess workers?
