Employee Not Serving The Notice Period

Dear Sir, Iam working for an X company i have told my company Please release me as per the company terms and conditions of employment mentioned in my appointment letter. In my appointment letter the terms are writen are mentioned below I need to give three months of Notice period or else i need to pay the salary for which notice priod is not served if company doesn't not want the employee to serve teh notice period the company would pay the notice period. I am ready to serve the company for 3 months notice period Now the cmpany is saying verbally that you will have to serve one month of notice period and pay the company company for two month of notice period. Can you please guide me on this

Hi, No one can force you to payback your notice period amount. You can contact your companys HR head directly and discus the matter. Tell him that as per the company policy you are serving full 3 months working notice period. Talk to him straight away regarding the notice period clause mentioned in your appointment letter. Hi Zaheer, If the letter says that you need to serve notice period of 3 months you should do it and if you are serving less than three months you need o pay back to company. But if the company is aksing to serve notice of one month and return money for the rest 2 months, that is not done. You should talk to your HR and get it in written. Regards Anuradha Singh

I have already resigned from the companny(CEO) and told the company Please release me as per the company terms and conditions of employment mentioned in my appointment letter Its been 15 days since i have put in my resignation and they have not replied by back to that but they have told me verbaly you will be required to serve one month notice pay and pay for the next two months He has also stop my salary or last month and this month so that he woudl be able to recover the notice period. The company deposited the salary in my account and removed the salary from my account as i was talking to the employer(CEO) about resignation. Can you please let me know what action i can do in this case.I am really worried about this

Hi, In your case the company seems to have your necessity only for a month and want to releive you after that. Nevertheless, inorder to not make your case as an example for others who see releiving without payment, they are asking for the repayment. I would suggest that your current mode of action should be "discussion and settlement". Confrontation can only lead to a unhappy ending to your current relationship which will be more detreimental than beneficial. cheers badri

dear Badri they are not ready for discussion they what ever we say is final they already have my two month salary they are not loosing any thing iam loosing every thing can you please guide me what can i do in this case

Dear Zaheer, Contact a lawyer how can help you in this it seems that thy have not paid you for the work you have done after informing on resignation which you have alrights to claim back. Scs

I do agree with Mr Badri. However the act of your employer is not ethical one. Other option is you can negotiate with your new employer to reimburse notice pay in case you decide to settle the matter with your current employer.
