Exploring ESIC Implementation in Schools and Employee Benefits

Dear All,

Why is ESIC not mandatory in schools whereas PF is mandatory? Why are the staff of schools not receiving benefits from ESIC? ESIC should be mandatory in schools. Female staff are unable to receive any benefits from the school such as maternity leave or coverage for other illnesses.

ESI was originally framed for industrial workers but later on extended to commercial establishments. You cannot rule out the possibility of enforcing ESI in schools.

Provident Fund is in the nature of a retirement benefit and therefore it is made applicable to all, including schools and other non-trading non-profit organizations. School management is expected to grant maternity benefits to the women employed therein. There is no exception to it.

Why is the Labour Department not enforcing ESIC in schools? 99% of schools are not covered under ESIC. The lower admin staff are taking medical benefits from outside by paying heavy bills.
