Is Shop & Establishment Registration Needed for Our Mumbai Toy Shop with One Employee?

Hi Everybody,

Please let me know if registration is necessary under the Shop & Establishment Act under the following conditions:

1) We have one shop in Mumbai where we are selling educational and scientific toys. We started this shop in January 2005, and the rent is paid monthly by our sister concern company. The rent agreement is in the name of the sister concern company. So, is registration necessary? If yes, what documents should we provide, and do we have to pay a penalty for not registering when we started the shop in January 2005? We have only one employee.

Please inform me as soon as possible.

Dear Tejesh,

The Shops and Establishment Act is enacted by the state, and in most cases, it applies to shops and commercial establishments having a specified number of employees or more. So, kindly find out the minimum number for Maharashtra/Mumbai (if you have a specific act).

Thanks for the reply. Please see the attachment, which I got from the internet, showing the fees based on the minimum number of employees. Kindly refer to this attachment. Could you please advise if we should apply for registration? If yes, what documents should we provide, considering the rental agreement is in the name of a sister concern company?

(Note that we opened the shop in Mumbai in January 2005 with one employee. Will we be subject to fines if we proceed with registration?)

Dear Mr. Tejesh,

You will have to certainly apply for registration. Regarding the documents to be provided, they may ask for the rental agreement with the owner of the premises. There may not be any penalty since you are voluntarily opting for registration. There may be a surcharge.
