Understanding Pension Timelines: When Do Workers Over 50 Start Receiving Payments?

airavat19aks
Dear All,

We had a strike at our factory last year. The workers filed a case against the company and have lost it. This incident occurred in May '07. They are now coming to fill out their PF and pension forms.

My question is: When will the people above 50 years old receive their pension? Is it from the date of their resignation, the date the forms have been submitted, or the date the forms have been processed?

Dear Aparajita,

Please note that only when employees resign, separate, or opt for VRS can they apply for PF withdrawal. For application to the Members' pension at the age of 50 years onwards and two months after their resignation or separation from the company, they need to apply. This process starts from the date of submission of the application form in 10D for Members' pension to the PF authority. Regarding withdrawal in Form 19, apply for the Pension Scheme Certificate if not obtained from the PF office.

For receiving a pension under the EPS, the date of job loss or relieving is irrelevant, but the date of birth is relevant. One starts receiving the pension upon attaining the age specified in the Act, i.e., 58 years for full pension or 50 years for reduced pension.
