Understanding Leave Eligibility in Karnataka Factories Act for Electronics Workers?

I am new to this forum. Wishing you all a very happy networking. I am looking for information on Leave rules in Karnataka Factories Act. What are the leave eligibility criteria for an employee working in an Electronics manufacturing company? Are they eligible for CL/EL/ML, and if so, how much is it and how is it calculated according to the Karnataka Labour and Factories Act? Can someone help me?

Hi,

To become eligible for leaves, an employee should have worked for 240 days in the preceding year. After becoming eligible for leaves, they will receive 1 day of earned leave for every 20 days worked and one day of sick leave for every 30 days worked. Earned leave balances can be carried forward to the next year, but sick leave cannot.

Hi GK,

Karnataka - For the leave calculation, during a calendar year (Jan-Dec), for every 20 working days, one leave is eligible. If a person joins in the middle of the year, for the remainder of the calendar year, they should have worked two-thirds of the total days. Half a leave day should be taken as one day.

As for Maternity Leave (ML), an employee should have worked 80 days preceding her confinement. The eligibility for leave is 12 weeks, including prenatal and postnatal periods.

Regarding Casual Leave (CL) and Sick Leave (SL), the Factories Act is silent. You can establish your provisions accordingly.

Hi,

If we take leave on Saturday, Sunday is off, and on Monday, we take leave again. Will three leaves be considered or two leaves?

This is typically called a Sandwich leave; it would be considered as a 3-day leave.

There is a rule or it comes under some act, I got a query from my employees on how to explain it to them. Please tell.

a. An employee will be eligible for Earned Leave only if the employee has worked for at least 240 days in the calendar year, or in the case of a new employee who has joined after January 1st of the said calendar year, if they have worked for at least 2/3 of the remaining calendar year.

b. While availing Earned Leave, intervening weekly offs and paid holidays are excluded.

Maternity Leave:

a. Every female employee shall be entitled to Maternity Leave for a period not exceeding 12 weeks (6 weeks before delivery and 6 weeks after delivery) after she has worked for a period of not less than 80 days in the 12 months immediately preceding the date of her expected delivery.

b. All holidays occurring during the leave shall be counted for the purpose of computation of the 12 weeks.

c. Female employees covered under the provisions of the ESI Act will be eligible for maternity benefits/leave as per the provisions of the ESI Act.

Leave Rules and Eligibility

As for the rules, there is no specific notification or law stating that a certain number of earned leave (EL) days can be encashed anywhere. However, there is a ruling that for every actual working period of 20 days, you earn one leave. The encashment details are not available anywhere to date.

Maternity Leave

For maternity leave, an employee should be in employment for 80 days prior to her delivery date to avail of the leave.

Casual Leave and Holidays

Casual leave and holidays are at the discretion of the company to determine the number of days or fix the number of days.
