Termination Procedure Help: What Are the Legal Notice Requirements to Avoid Litigation?

jjaydip
Can anybody help me with the termination procedure? Specifically, I am looking for information on the legal aspects of termination such as how much notice is required at a minimum to avoid litigation.

You cannot terminate an employee during the probation period. You have to issue warning letters, issue a charge sheet, and hold a domestic inquiry. It is essential to read about the topic on standing orders and the ID Act.

Dear HRs, kindly clarify the following points:

1. If management terminates the services of a probationer as per the appointment order, giving him only the salary for the days he worked during the month of termination, is it correct? Is he not eligible for EL, SL as he has completed more than 240 days of work during the probation period?

2. Will his full and final settlement include the above-mentioned leave benefits or not?

Please clarify.

Thanks and Regards,
