Is Intranet Communication Proof Valid in Court? Seeking Insights from HR and Legal Experts

abhijitrk3
Hi all,

I am Abhijit, working with ICC/domestic CALL CENTRE as an Admin Manager. I would like to know if communication records kept by an employee and presented in court as proof are considered valid. For example, a report indicating that the concern has received and opened communication on the intranet – is this considered valid proof in court?

Yes, Abhijit. After the enactment of Cyber Law, all e-documents are recognized as evidence as good as any other document. The Indian Evidence Act was also amended in line with it. However, it is a convention that the courts insist on corroborating the document.

Hello,

Yes, they can be taken into account as proof, provided they have not been acquired by illegal means or if they cannot be obtained through legal channels. More details can be obtained from the Evidence Act.

Thank you,
Octavious

Dear Friend,

The answer to your query lies under the Information Technology Act and the Indian Evidence Act, which define e-documents. Therefore, emails come under the ambit of these acts.
