What is the format to calculate salary - on 26 days or 31 days?

For Leave Encashment:
Basic Salary per month * Nos of Earned Leaves left / 26
But I think following will be more accurate.
((Basic salary*12months)/365 days) *Nos. of Earned Leaves left

Hi,
Salary should be consider as per months days like January -31, Feb-28/29, April-30, May- 31 these days includes weekly off.
For Example:
May is having 31 Days
Working Days = 27 Days
Weekly Off = 4 Days
Total paid Days = 31 Days
Salary will be calculated on each head i.e Each Head/31 * total paid days.for example
= Basic/31* 31
In case of Absent or LWP reduce the no of days from working days.
Like
Working Days = 25 Days
Weekly Off = 4 Days
CL= 1( approved leave)
SL= 1(approved leave)
Total paid Days = 31 Days

To get the exact calculation you should go with 28/30/31 i.e. actual days - but most companies follow 30 days a month, I would say either choose the exact days or working days i.e. 26 days because 30 days include holidays, but maximum salary for a year is 30*12=360 days, what about the 5 remaining days in a year.

If your company has engaged 10 or more workers and using power in manufacturing activities than it is
covered under the provisions of The Factory Act 1948.
Please study the provisions of this act regarding Leave with wages and follow correct procedure.

After 6 working days 1 Weekly off is compulsory. Similarly 1 paid leave is to be granted for every 20 days
of physical attendance. As per provisions of The Factory Act you need to maintain Leave Register in Form
No.20. The Director Industrial Safety & Health ( Factory Inspector Office ) can take legal action against
your company for violation of act..
Please advise your management to follow correct practice and do not indulge in unfair labour practices.

Considering monthly salary as 26 days salary is OK .But reciprocally Tthe same logic should be applied to calculate the salary for leave/or holidays with wages or EL surrender etc.

As per above comments/reply: If we have to pay as per rate of minimum wages and it is calculated @ 26 days then when in any month 31 days comes with 4 Sunday. Then we should pay Rs ...... (Minimum wage rate per day ) X 26 days or Rs ...... (Minimum wage rate per day ) X 27 days.

Hello,
I have query related to salary calculation, one of our employee has gone on leave in the mid of the month and he will come back in the next month(taken leave from 18 jan to 5 Feb) and we follow uniform month policy i.e. 30 days policy.
In the leave period 2 Sundays are also included . So I am little bit confused with salary calculation.
Whether to pay for the both sunday.
Please help me to clear this confusion.
