I Think there is no option to be exempted from PF conribution.

Hi Priya,
Just a clarification on the withdrawal of PF. If a person has left the previous organization and joined some other organization immediately or in few weeks, than he/she cant withdraw the PF. There has to be gap of atleast 2 months between 2 jobs.
Lets say a person left his job 3 months gap and he withdraw his PF, now as there was Gap of more than 3 months in next job so in next company he can opt for no PF option.
if its not than he/she has to opt for PF.

pf contribution is mandatary with in pf act irrespective of age in case the person ramains as an employee and on attaing 58 tears no deduction to be made for family pension.this is what law indicates and implyed

Dear Priya,

1-Your employee worked for a govt. organisation and she got VRS.-This statement clears that at the time ot the seperation from the govt organization the emplyee didn't acheived the retirement age.

2-The employee used to deduct her PF in the govt organization-This means that she was a member of PF.

3-She joined in your Company in 2009 and she requested not to deduct PF & you did the process of signing the application-That means you definately gave her PF form- 11 for exemption to fill.

Now your query is:

You would like to know whether is there any policy that she can opted out from the PF contribution or is she suppose to pay the PF?

The ans is from option A & B :

A- If the employee has acheived the retirement age when she joins your organization she can be a part of the PF only not the Pension fund.

B-But if she didn't attain the Retirement age she will be eligible for both PF & Pension & Pension ceases when she will got the retirement age but PF will be applicable.

Remember one thing if any employee has been ever a part of the EPF he can not get rid off it for whole life of employement in all the companies.

The employees generally fill form 11 by saying that they didn't ever been a part of the PF but all the things can be trackable from the options available in form 11.
