Thank you Sir for your response
Much appreciated.
Have one more query
If the retrenchment is taking place due to the relocation of the process in a different facility and to a different location. Also in the interest of the employee the company makes the following offers
A - Subject to meeting the skill requirements of voice processing, and further, subject to successfully clearing the necessary interviews and training as required by the job specification. (offers this in the same facility at the same location)
OR
B - Accept an option of transfer to our differnt Facility to a process of parallel nature, subject to clearing the requisite training; as a humane gesture, in the event any employee accept this option, the company will offer such employee compensation higher than the one presently being paid to such employee
And if the employee doesn't choose either of the option and chooses to take seperation of services...can the employee challenge it in the labor court
Secondly what if the employee refuses to choose either of the option and also chooses not to resign. Can the company post the Pay Order through registered AD at his residence.
Awaiting Your response.
Regards,
Shweta
