As per ID Act the salary to decide whether an employee is performing duties of supervisory or managerial in nature or not remains the same, ie, Rs 1600. However, a more realistic definition has been given by the Apex Court as follows:
An employee who has any of the following rights is said to be coming under supervisory or managerial category.
1. One who has the authority to approve leave of his subordinates
2. One who has the authority to appraise (performance appraisal) other employees
3. One who has the authority to initiate disciplinary action against another employee.
Therefore, the above criteria may be applied to decide whether one is coming under supervisory or worker category.
