Dear sirs,

An employee has two wives, and he has nominated both wives in Form No. 2 (R) in PF. I am asking you, are both nominees applicable for PF and Pension? Or is the elder wife only for PF, and both for Pension? In this case, his elder wife can claim for PF only when his younger wife is refused because she wants both to receive the amount in a joint account or separate accounts.

Dear,

We always have options in Form No. 2 to declare the percentage of shares the nominees are going to get. If we have declared that, that's fine. If not, both the wives become eligible for 50% share each.

Yes, Rahul, you are right.

If that employee has nominated both wives, they will each receive an equal share of benefits, let's say 50% each, after completing all the formalities and submitting the required documents. If he has nominated only one, then the entire benefit will go to her, regardless of whether she is the elder or younger wife. Additionally, the children of both wives are eligible for the benefits until they reach 21 years of age.

Dear sir,

In this case, I have spoken to the PF department but have not received any satisfactory reply. They informed me that only the elder wife will receive the total claim of PF, while the younger wife may receive a claim under the pension scheme. However, when employees have a younger wife, they want to claim in both schemes. The elder wife's son wishes to receive the total claim.

Dear Mukesh,

Just check the percentage mentioned in form - 2 and stick to it. No PF officer can decide as they want or give an answer by just assuming. They have to adhere to the percentage mentioned. If possible, please inform us of the percentage.

Dear Mukesh,

For better clarity of the situation, please let me know the religious status of the employee. If he is Hindu, his first wife will be covered under the definition of family and will be eligible for all benefits, not the second wife, as Hindu Family Law does not permit this.
