Hello, I wanted to know whether the Foreman (Maintenance Dept.) and employees (60 plus) on a contract basis (Foreman, Electrician & Store Asst.) will be eligible for retrenchment compensation in the state of Uttarakhand.
Currently, the foreman is the head of the maintenance department and draws a salary of 35k p.m. Contract employees' salaries are as follows: Foreman - 35k p.m, Electrician - 14k p.m, and Store Asst. - 16k p.m.
Does office staff fall under this benefit? Also, what other factors must be taken into account for a worker's classification to be eligible for retrenchment benefits?

Retrenchment compensation eligibility
Retrenchment compensation is payable to all workers who do not have any subordinates or reportees under them. However, the Foreman, being the head of a department, should have supervisory rights and, therefore, will not be entitled to receive any retrenchment compensation.
Premature contract termination
On the other hand, if the Foreman is appointed for a fixed period, for example, two years, terminating that contract before the expiry of the fixed period would constitute premature contract termination. Such termination should only be carried out by following the termination clause stipulated in the contract of employment.
