Madhu.T.KYou can have N number of factories within a compound. But if there exists financial integrality, ie, transfer of fund from one factory to another, for the purpose of application of labour laws like, Employees Provident Fund Act, ESI Act, ID Act, Gratuity Act etc the establishments will be clubbed together and the total number of employees put together will decide the applicability. For applicability of ESI, though it required only 10 workers and if you have a unit with less than 10 workers that unit will also come under the ESI on the presumption that the number of employees in the other units put together exceeds 10. Similarly for PF, if you have made it applicable to other units or the number of employees 20 in all, the coverage will be there for units with less than 20 workers also. The applicability of chapter VB of ID Act and similar other enactments will also be governed by the total number of employees in all the units put together.
