Transfer is an incidence of service, and it is the prerogative of the employer to decide who among their employees will work, where, and for how long without detriment to existing service conditions and the status of employment of the transferee. The personal inconvenience, if any, caused to the transferee cannot be a reason to resist the orders of transfer, which is always an administrative exercise in the interest of the organization and as per the terms of the contract of employment or service regulations. It can be contested only on the grounds of a colorable exercise of power or as a measure of victimization by the employer. If the transfer is likely to cause personal problems, it is advisable to approach the CEO and request a cancellation.
