Hi, I would like to know about maternity leave through ESI - when can a person avail the same? Is it 6 months' leave? Can she get ESI benefits even if she resigns from the company?

Maternity Leave Through ESI - Eligibility and Benefits

In India, the Maternity Benefit Act, 1961, governs maternity leave provisions for women employees. Under the Employee State Insurance (ESI) scheme, a female employee is eligible for maternity benefits if she has contributed to the ESI fund for at least 70 days in the preceding contribution period. The maternity leave duration under ESI is typically 26 weeks, which includes 8 weeks of leave before the expected delivery date and up to 18 weeks post-delivery.

Availing ESI Benefits After Resignation

If a female employee resigns from the company, she can still avail of ESI benefits for maternity leave if she meets the eligibility criteria mentioned above. The ESI benefits are tied to the contributions made during the specified period, irrespective of the current employment status. Therefore, even after resigning, a female employee can claim maternity benefits under the ESI scheme as long as the contribution requirements are fulfilled.

It's essential for employees to be aware of their rights and entitlements regarding maternity leave and benefits under the ESI scheme to ensure a smooth transition during pregnancy and childbirth.
