I am working for an Engineering Company dealing in DBOT work where the office is situated in Delhi for design work & the manufacturing workshop is being situated at Gurugram. Can anybody tell if it falls within the ambit of the Factory Act? I have resigned with my employer who is not into the habits of paying earned leave during full & final settlement. I have to raise him a notice seeking payment of Earned leaves u/s 79(3) of the Factories Act.

Dear ,
Whether you fall under Factories Act or otherwise, fall under Shops & Estb Act, you are liable to get along with your full and final settlement, the salary in lieu of Leave in your credit.
In Shops & Estb Act also provision is there alike Factories Act. Only thing is you need to approach not to factory inspectorate but to the authority under the Shops & Estb Act.
