Sir, Please answer that Petrol Pump license covered under factory act 1948 for Karnataka, Maharastra, Haryana, Punjab, Tamilnadu, West bengal. If any supporting documents please share.

Hi Umesh,
There have been some articles and debates on this subject and what has been conveyed is that if there are 10 or more members working on day at a petrol pump with the aid of power ( machinery), it is considered as a factory.
This is because the definition of "manufacturing process" under the factories act includes pumping oil for the purpose for sale, as one of the activities.
But in a court case a few years ago, there had been an instance where there had been only 7 members working at the petrol pump and the ESI inspector had served a notice for not activating ESI benefits. The court had overruled the ESI inspector's statement, stating that at least 10 members with the aid of power should have worked on the same day, and hence the petrol pump could not be considered as a factory in this particular case.
