Hi, Need an advice. Organisation has 6days working per week with Sundays as weekly off. An employee takes leave on Saturday and following Monday (Prefix and suffix). Will the Sunday be considered as leave days as well (sandwich leave concept)? Company following leave policies as per West Bengal S&E act. Kindly help by providing valued suggestion from compliance and legal view point for formulating of proper company leave policies.

Dear Friend, Satyanarayan is right. There is no such concept of Sandwich leaves in any acts, this is designed by companies.

And Mr Ravi,
Please confirm the below
1) In factories act ,CLRA there is no CL,PL, Only EL's are eligible
2) In Shops,Establishment act CL,PL,SL,EL'S ARE eligible.
3) And share the staff eligible leaves in Factories act ...

Dear Friend, As per shops and Factories act, For every 21 days of working one paid leave has to allow.

So far my knowledge goes, Sandwich leave has not been mentioned in any Act. Moreover, Leave policy is varying from organization to organization. Usual practice ( even in Govt. Sector-Bank etc.) Privilege / Earned leave which employees enjoy for long holidays/ family tour etc. , in that case in between public holidays / weekly offs are counted. Same is also applicable in case of long sickness. But Casual leave is allowed without counting public holidays / weekly of days. There are organizations who are following S & E Act, WB also has above system.

Dear Ravi and Satyanarayana,
Sandwich Leave concept is not only applicable in Companies but also in Government Sectors. I would like to ask one question, if an employee is absent due to illness for around two months and all his leaves are already exhausted then how many days salary will you pay him in those two months?
You need to be present pre or post, atleast one day to avail the benefit of an Holiday or Weekly off.
I don't think any body can even challenge this in Court.
