jpratapYes, it is applicable in both the instances as quoted by you. However, you will face problem in constituting the Internal Committee because it requires at least 2 women members i.e. 1st being the Presiding officer of the Committee and the 2nd as an ordinary member.

It does not matter what the number(even number is one) is and whether they are employment on regular or contract basis.

Prabhat Kumar SanghiThe POSH Act is not clear on this issue. As per the Act minimum two female employees shall be the part of ICC (Internal Complaint Committee), one presiding officer and another normal member, this is mandatory but where there is only one female employee how it can be meeted?
