Hi,
I have a query regarding Maternity leave benefit. I joined my current organisation in Jan-17 and my ESI contribution starts from Jan-17. My baby was delivered in Sep-17. My Organisation allowed me maternity leave for six months but ESI-BO refused to pay maternity benefit as I have not worked for 9 continuous months in my current organisation. But I have completed my 84 working days according to rule.
Please advise

HI,
No, your employee is not eligible for Maternity leave of 26 weeks from ESIC and the same should be paid by the employer only. Because for claiming maternity benefits from the ESIC employee has to contribute at least for 2 years.
