I left my previous organization on 19-08-2016 with immediate effect and i put the resignation for the same.
I did not serve the notice period which was for 2 months and same i told the HR of the organization via email and also i told them via email that you forfeit the amount of notice period as per HR policy and i am ready to pay once i get the statement of my full n final settlement.
Now they are giving me my receiving letter of 18-10-2016 because i did not serve the notice period and when i told them i was not present in the organization than how can you give me and they told me that you were on leave and that is on leave without pay then i told them there was any communication or exchange of mails that i was on leave or i told them whether i submitted any leave application.

any leave application to you. But they are not doing as per policy. Now please suggest me the best possible solution and also suggest me if i will take any legal action againt them so will i take tht.

Dear Mr Jitesh,
before you venture in to further , Please post in Simple words what is your grievance against the Management? What relief you expect? it appears that you have not mentioned in your resignation Letter that you are leaving with immediate effect.How management can Forfeit Notice pay? Had you given any Money to the management, so that they can deduct the same towards Notice pay? Have you paid notice pay?
