Dear all

One of the my friend is in teaching job in private school one day my friend receive a message from chairman that he has not to go to school on mobile.and after two day he received a mail for his details of account that to be paid to him after 15 days with his wife account details also she is working with him. Account details contain payment of one month salary advance and for wife it is written as notice period for next 30 days on those days she has to attend the SCHOOL. No official termination letter is given.after that school paid the account of my friends but they terminate the his wife with reason "recorded reason" after completing the notice period this time they give the termination letter by new principal.

My friend is getting aprox 28000 pm but he has not give any form 11 for not to deduct pf.his pf is deducted but now school management is saying that your pf is not deducted and you have no pf account.

They are not paying the earn leave casement also.

Kindly suggest me he can take the help from law.

when basic +DA is above 15000/- per month, and the employee did not have any previous EPF account from past service, then EPF is not mandatory for such employees,
the employee had to fill form 11 and had to show his willingness to contribute to EPF at the time of joining with all KYC documents copy, otherwise the employer can not add the member in EPF
