Thanks in advance. I have a query regarding compensation. I work in an IT Pvt Company. After one week of my resignation, the company announced a bonus for employees for their past contributions towards the organization. Since I have been working for the last 6 years with the organization, I thought I would be entitled to this bonus. However, as I haven't received the bonus, I asked HR about it, and they said that employees who have tendered their resignation are not eligible.

Eligibility for Bonus After Resignation

I want to know if the company can decide this on its own. For better understanding, I would like to add further information:

1. I am still working with the company under my notice period, so when the bonus was announced, I was a legal on-roll employee of the company.
2. There was no prior information regarding this action that employees who have tendered resignations are not eligible.

Legal Reference for Bonus Eligibility

Is there any legal act under labor or employee relations act to which I can refer?

First find out whether the bonus is paid in terms of the Payment of Bonus Act. If not, then I do not think you have much remedy.

Please let me know the Financial Year for which Bonus is Paid (2015-16 or 2016-17). Is your Basic/DA/VDA less than Rs21,000/-PM to be eligible for The Payment of Bonus Act, 1965?

Under the Payment of Bonus Act, an employee who has resigned from the service is also eligible on a pro-rata basis.
