Unjust Treatment in the Workplace: Seeking Legal Advice

I'm a Clinical Trials professional, holding a Master's Degree in the same field. I am a victim of being accused, harassed, abused, used, and then forced to leave.

Issues Faced

1) Confirmation of a job offer by email without any salary mentioned, no salary structure, no SOP followed, no ID provided, non-compliance with commitments upon joining, false promises, offered less than the agreed/confirmation email salary, fraudulent promise of settlement within 6 months, excuse of misunderstanding even after written evidence.

No salary structure was provided, and I was offered less than the basic salary. There were unnecessary and irrelevant deductions, false promises of confirmation, and commitments to compensate in 6 months. Deductions were made as per an Executive Employee, but benefits were given as an apprentice.

Breach of HR Commitments

I trusted HR commitments to wait for 6 months, even after confirmation. There was no compliance with promises, variable statements changing at variable times, and I was forced to resign with no salary provided. I was considered on leave without a notice period, with no compensation even after a month, as I was forced to resign due to the insecurity of the senior's past misconducted work. There was a culture of abusing, harassing, and warning of physical harm to employees.

Seeking Legal Action

I want to sue in whatever ways possible, as per IPC acts and laws. I have enough evidence to sue the employer and HOD. I have already notified in detail all applicable government authorities as well as the Foreign Ministry about the critical misconduct of the HOD. To secure my job, they ruined my career. It has cost me financially as they already deducted my salary and are now not responding to provide what is due, including LTA. They deny providing the fuel cost bill for daily service.

I have already invested 200/day of my own money by trusting their words to wait. I am seeking legal whistleblower advice. I do not want others to be victimized again.

Legal Steps for Addressing Employment Issues

This is not yet a criminal matter. If they have forged a document and given that to you, then you can bring Section 420 along with 468. Other than that, it is not an IPC issue. It's more of a civil problem.

The better way is to start a prosecution under the Shops and Establishment Act of your state. Go to your city labor office and lodge a written complaint about pending wages. They will take up the matter. If they have not made your contributions in PF and ESI, then you can file a complaint in that too.

Also, you can go to the Labor Court under the Industrial Dispute Act. But more information on the nature of your employer is warranted.
