Supreme Court has held that compensation under Employees Compensation Act is payable even in case of negligence of employee. It is different than compensation under Motor Vehicles Act where negligence matters. Copy of judgement dated 4.2.2016 in this regard is attached.

This is not the new finding of SC .Sec 3 of the EC Act says that employer is cannot disown responsibility of paying compensation on account of injury caused by negligence provided the injury results in death.
