Hi all,
Can you give me an advise regarding 13th month pay for those employee who are on unpaid leave and on maternity leave are they still be given 13th month pay or those unpaid months will be deducted to their 13th month pay?

From Philippines, Cebu City
The minimum 13th month pay required as per philipines Department of Labor and Employment, shall not be less than one-twelfth of the total basic salary earned by an employee within the calendar year, provided the employee worked for at least one month during the calendar year.
If the period of calender year includes unpaid leave, then payment of the 13th month pay is entitled to this monetary benefit "in proportion to the length of time he worked during the year".
