Dear Seniors, I need your input on the leave policy for a U.S. healthcare BPO (Pvt) in Chennai. We have designated different sets of calendar holidays for employees working in day shift and US shift timings. We operate 5 days a week.

Statutory Leaves and Breakdown

Kindly assist me with the statutory leaves that need to be provided and the breakdown of such leaves in a year. This information is required urgently as we are in the process of formulating our leave policy. I am expecting prompt guidelines on this matter.

Compliance with State Leave and Holiday Regulations for BPOs

BPOs come under the State Shops and Commercial Establishments Act. Therefore, you may follow the leave provisions under the Shops and Commercial Establishments Act. You are free to give additional leaves, but as you mentioned 'statutory leaves,' you have to adhere to the Act and frame your policy in alignment with it. Typically, this includes around 12 days of casual leave, 12 days of sick leave, and 12 days of earned leave (after 12 months of service).

Regarding holidays, you must comply with the State (Tamil Nadu) Industrial Establishments (National and Festival Holidays) Act to determine the number of holidays to be given to employees. In Tamil Nadu, there are nine holidays, of which four are National Holidays that cannot be altered. However, five festival holidays can be decided by you in consultation with your employees, taking into account religious and other sentiments, such as client visits and their timing.
