My query is regarding the payment of Gratuity. There is one employee (age 30 years) who has completed only one year of service. His present basic pay is Rs 10,000/-. Unfortunately, he passed away at the age of 30.

I would like to know if this employee is eligible for gratuity. If yes, could you please provide the calculation formula?

Gratuity Operations and Claim Process

My query is about the operations of Gratuity. In the case where a member has completed the minimum service required for Gratuity but has not claimed it, there seems to be an issue when renewing Gratuity with LIC. LIC mentions adjusting the withdrawal benefit.

After a few years, if the member claims the Gratuity, LIC may not have a record of it since they have already cleared the case. How can we keep track of the payment of Gratuity in such instances? Is there a time limit for claiming Gratuity?

For example, if LIC pays the Gratuity and closes the case, but the member later reclaims the Gratuity after a few years, what is the process?

Additionally, if a member leaves the company after 10 years without claiming Gratuity, can they still claim it after 5 years? Who is responsible for keeping records of whether the payment of Gratuity has been made or not?
