At the time of my joining in June 2010, it was mentioned in my offer letter that I would receive a certain amount of Rs. X thousand as a retention bonus after completing 4 years with the company. Last year, starting from July 1, 2013, I was on educational leave, which was completely without pay (LOP). I have recently returned to work this month. The HR department is now stating that I am not eligible to receive the retention bonus this year. However, I believe that even though I did not actively work for the company last year, I was still an employee on LOP. Therefore, I believe I should still be entitled to the retention amount.

Please advise.

Just my opinion—during the one year you did not contribute to the company, the company adjusted to your wishes to study further, which may benefit you for a lifetime, while you could leave the company at any time. So, I don't think the company is being unfair. By the way, it may have been better to clarify this before going on leave.

Every company should be transparent with its policies. When seeking information about the retention policy and eligibility for retention, consult HR. If, according to company norms, you are not eligible, then your employer is correct.
