Dear All, I have one query related with EFP. Request a reply from epf expert. Thanks....

My concern is that if any organization registered for EPF in March 2014 and got the registration number in march 2014 & then paid the challans of employees from Dec 2013 onwards which results in delay payment for Dec 2013, Jan 2013 & Feb 2013 challans.
As the registration was done in march 2014 so there was no other option to stop the delay payment of challans from Dec 2013 to Feb 2014. So, please update me is penalty be applicable on organization for these 3 challans or that can be waived off as practically that was no one's fault.
Do need to pay penalty or interest or both & how much.
Request your advice.

Hi,
When you got the registration code from that period you will be eligible, just tell me when you have not received the code then how you are going to pay the amount of precious months.
That is not your fault, your eligibility is from March itself.

yes aditya we got the code in march 14 but we paid from dec 13 so do we need to pay penalty as well as interest for previous months pls reply

Dear,
Seeing to the remittance you made since Dec'13 to Feb'14 your coverage is from back dated, so in that way it falls under belated dues remittance hence Interest & damages is payable reading the section under the Act i.e Section 14B.

Dear,
Yes, loss of interest and damages both to compensate the period of delay according to rates given in the Act.
You don't need to work anything on this concern, PF authority shall directly send you notice for the same in case they identifies it.

It is the prime responsibility of the establishment to get the establishment covered in time as and when the act is applicable under section 1(3) or 2A as the case may be.
In case the establishment was cover-able from December, 2013 and you applied for registration or obtained code in March, 2014, you are liable for imposition of interest and damages under section 7Q and 14B which are detected later by the department and opportunity is given to hear you before such action.
However, if you applied for coverage in time but allotment of your employer's code is delayed by the department, you can raise the issue before the competent authority i.e. RPFC where damages part can be waived off subject to the favourable facts of your case.

You need not pay the interest for that period because it is not
your actual delay.
In case, they issue notice to pay the interest, at that time you can inform the same in your reply.
Actually the PF inspector will inspect all these payments during his visit.
Based on his inspection report, the PF authorities will issue notice
for payment of interest on delayed payment
Now you need not worry about interest payment.
