My Queries -

1. What is the way out if there is a MISMATCH OF PF NUMBER in company records and PF commissioner office records?

2. Is it possible for a member to get the records rectified himself and withdraw his PF without involving his previous employers?

3. What can a member do without involving the previous company?

Following is a detailed description of my case for correct understanding:-

I worked for company X from Nov-2003 to Nov-2004. After that, I joined some company Y and cleared all my standing dues with the previous company X.

After clearing all my dues with company X, I started the process for the withdrawal of PF amount. I sent duly filled PF withdrawal forms which company X attested and sent to the PF commissioner's office. The PF commissioner's office rejected the forms with the reason that the records don't match (Actually company X has discrepancies in their records for PF number which they didn't observe when company X opened my PF account with PF commissioner's office).

Since then, the forms have been sent many times to the PF office but the issue didn't get resolved. Now, the HR Manager of company X is not cooperating since I complained about the INFINITE DELAY to higher authorities.

Now I want to know what I can do from my side to solve the problem of PF number mismatch in company records and PF commissioner office records?

Please help since it's almost 2 years.

Regarding your query,

1st step: Please check with your previous employer's HR department whether they updated the Form - 9 register. If so, then check your payslip; definitely, they mentioned your PF account number. Since you are saying your PF withdrawal forms are forwarded for attestation, the principal employer, while forwarding the same to the local RPF office, a copy of the letter is supposed to be sent to your address for information. If such things are not done properly...

2nd step: You write your complaint to the local PF enforcement officer about your query and cc to the RPF Commissionerate.

Answer to your queries: -

1st step: Please check with your previous employer's HR department whether they update the Form-9 register. If so, then check your payslip; they definitely mention your PF account number. Since you are saying your PF withdrawal forms were forwarded for attestation, the principal employer, while forwarding the same to the local RPF office, is supposed to send a copy of the letter to your address for information. If such things are not done properly...

The HR Manager is not cooperating at all. Basically, I'm helpless. The PF number mentioned in my salary slips is wrong and does not match with the PF Commissioner's office records. The HR manager never forwarded any copy to me when they sent attested forms to the PF Commissioner's office. But it is written in company law and PF guidelines; hence, it is just supposed.

2nd step: Write your complaint to the local PF enforcement officer about your query and cc the RPF Commissionerate.

I have written many emails to the PF Commissioner's office email id but received ZERO replies. They have put up email ids that nobody checks, and nobody cares to reply.

My Dear,

Good morning.

In the end, please forward the copies of all correspondence to The Central Provident Fund Commissioner with the request letter and also send a copy to the R.P.F.C. and PF E.O. for information and necessary action. In my opinion, your problem will be resolved within three months. Before taking the above action, consider the possibility that your relationship may discontinue with the principal employer.

Hi Lalit Ji,

Please take a practical approach. I tried everything, and it's India. Sarkaari Babus don't give a damn. Believe me.

As far as the relationship is concerned with the previous employer, they ruined it since I gave them 4-5 chances to get things in place. 2.5 years' time is quite enough to toss the world.

What do you suggest? Should I care for this relationship?

One of my problems got solved:

Problem #1 - What's the procedure to be followed by the member if the employer is not cooperating/attesting his claim forms?

Solution - When a member finds it difficult to get the form attested by the employer, he can get the attestation of any of the following officers and send it to the Provident Fund office:
1. Manager of a bank.
2. Any gazetted officer.
3. Member of the Central Board of Trustees/committee/Regional Committee (Employees' Provident Fund Organization).
4. Magistrate/Post/Sub Post Master/President of Village Panchayat/Notary Public.

Now only one problem is left:

Problem #2 - How to approach the PF Commissioner and rectify the discrepancy of PF Number in their records.
