Dear All,

We have registered a consulting company in Bangalore with our residence address, As earlier we didn't had office space, Now we are incorporated as pvt ltd by ROC Bangalore. Now we plan to set up a office at new address which is different than our registered residence address with RoC , Below are two queries regarding Shop & Establishment act registration

1.) Our Pvt Ltd company registration has our residence address But we want to avail the shop and establishment registration with our real work address / office address, will it be ok ? will the documents suffice ?

2.) Also we plan to work from our office address only , so we will apply for shop and establishment registration for our office address , Do we still need to apply for shop and establishment for our residence address as well because its the address mentioned in certificate of incorporation provided by RoC ? Or we can live with only one shop and establishment registration for our office address only

Note : We dont plan to change our residence address with RoC at the moment, reason being is we want to keep one permanent residence address for our company with RoC and based on our company growth the actual work address may change later so that's the only reason to have residence address with RoC and actual work address as different, So please advice do we need to have shop and establishment registration for both or just our real work address . Also at residence we wont work at all its just used for registration address

Hi, You can Register under shops act with your new address, (Branch), keeping the address in the ROC (registered office) unchanged.

Dear Varma,
The shops and commercial establishment Act does not says that your ROC address should be the address to be shown in the the registration certificate. In the certificate the address from where you are really working has to be shown and recorded in the labour department. In your post since you have stated that in ROC address you are not at all working. Hence there is no need of taking shops and establishment license in the ROC address.
You need to only take license for your office address.
Only thing is that when you take license for your office address you should show the rent deed before the labour officer.
But for taking license for office address the ROC certificate is not sufficient.You have to show the rent deed.
The certificate of ROC is taken only to show that the particular company have been formed and it has been registered.
There is no need of changing the address in ROC for getting the registration certificate under Shops and commercial establishment act.

Your ca is dead wrong
And your approach is correct
Keep your home address as registered address. It makes sense to have an address that does not need to be chaned.
Since no one is working there, you do not need to take a shop and establishment license there.
Your actual office can be at a different place and the shop and establishment license must be taken for that place.
The roc address and shop and establishment address had nothing to do with each other

Dear , It is required Under Shop & Establishment Act , you may take registration for your office with more than 5 employee , Registration purpose you contact BDA .They will assist you.It is normal fee's will collect , why you take risk , better to get registration safer side.

Dear Sakshi Verma
The shosp act is applicable to apremises where a trade or business activity is carried on. Since you are going to work and carry on business at the new address, the registartion under the Shops act shall be done for the new address but not for the residential address.Othere members have calrified the issue sufficiently.

Dear,
No new regn. is necessary whatever you wanted to do. There is a Form A, file it with attachments as Vilas Shinde mentioned, remit the challan depending on the work force. The Labour Dept. will issue a Amended certificate (for 5 yrs.). If need be there are Consultants who will get it done for U and charge 1000 or 2000 Rs. Similarly RoC also.
