Request for Expert Opinion on Minimum Wages Notification

We have attached the following documents for your opinion:

1. Copy of Notification Effective from 15th April 2011
This notification is provided in two formats, offering information about minimum wages in hospitals.
a. According to our knowledge, the basic rates defined comprise Basic + Daily Allowance.

Please consider the following points in the notification:

- (d) The minimum rates of daily wages payable to an employee employed on daily wages shall be computed by dividing the minimum rates of monthly wages fixed for the class of employees to which he belongs by twenty-six, the quotient being stepped up to the nearest paisa.
- (e) The minimum rates of wages shall be inclusive of payment of remuneration in respect of the weekly day of rest.
- (f) The minimum rates of wages shall consist of basic rates and the cost of living allowance.

2. Minimum Wage Bifurcation of Basic Rates
a. Line 27 shows a special allowance for hospitals as 1316.25, which is included in the minimum wage of Rs. 5300/- for unskilled labor.

For example, is it structured like this?

- Unskilled: Rs. 5300 + 1316.25 = Rs. 6616.25 p.m. total salary

or

- Unskilled: Rs. 5300 - 1316.25 = Rs. 3983.75 p.m. basic

There is a latest change in the special allowance effective from July 14 to December 14 from the Maharashtra government. Our company is registered under the Factory Act Section 2(m). Is there any revision in the basic pay due to this change? There seems to be a slight difference between the old special allowance and the new special allowance. Please guide.
