We are running a Show room with 3 staffs & 2 carpenters;
Holidays Listed for 2012 is 12 days
staffs Leave allowed 24 days/ year;
Carpenters= Along with the Holidays How many days leave can be allotted.
Kindly forward your suggestions as per the act.

Hope it is a furniture showroom. Carpenters are on company role or contract role or daily wages.
Company Role - should treat them as other sales staffs.
Contract Role - The contractor will take care and replacement will be given on their absence.
Daily wages - just day off is enough for 6 working days. If they take leave you can deduct the salary.

Basic + DA = 60%
HRA - 20 %
Conveyance - 10 %
Medical / other allowance - 10%.
Hope you are a growing organisation - When you are coming under ESI (Hope you are aware ESI Dept has proposed for change from minimum 20 to 10 employees which will be done in 1-3 months) & PF act you will be having only minimum employees for contribution since your salary range is between (10000 - 40000) many employees will be having a basic of above 6500/- where you can get the exemption from PF contribution or make Rs.780/- as maximum contribution.
Basic - 50%
HRA - 30%
Conveyance - 10%
Medical / Special allowance - 10%

as per TN Shops & establishment Act. act, The EL - 12 days and it can be accumulated to 24 days.
please let me know if my leave exceeds 24 - say 28 on the 3rd year of my service , whether the company has to pay for remaining 4 days or will it be lapsed?
Please also mention the rule where i can get the information Hn TN Shops & establishment Act.

you can accumulate EL for a maximum of 90 days.
Todays scenario it varies from company to company. some company will credit 30 days in advance at the start of the year and will carry forward 15 days next year if leave balance is more than 15. other leave will be lapsed. next year 30 days will be added to 15 days.
30 days EL is derived from 2.5 days per month.

you can apply form V A to the respective DIL / LI in your circle.
Since you are a online retailer your warehouse has to be registered only in shops and establishment act.
"shop" means any premises where goods are sold either by retail or wholesale or where services are rendered to customers, and includes an office, a store-room, godown, warehouse or workhouse or work place, whether in the same premises or otherwise, used in or in connection with such trade or business but does not include a factory or a commercial establishment;

In case, you have not got the clarity on this registration part in Tamil Nadu...
We would say, it is not required to get the registration certificate under the TN Shops & Establishment Act and there is no official formality to get the same.
But, Instead of obtaining a registration certificate under the Shops & Establishment Act, Each and every establishments have to obtain a formal approval from the authority under the TN Industrial Establishments (National & Festival Holidays) Act, 1958. It is nothing but a "Festival Holidays Approval".
As for as Tamil Nadu concerned, it is treated as a Certificate of Registration and it is mandatory to obtain the same.

Yes, nowhere talks about the employees strength under the Tamil Nadu Shops and Establishment Act. This Act is applicable even for engaging one+ employee in the establishment. But, you can get the exemption from the submission of returns and maintaining registers, it depends upon your establishment's employees strength. There is a provision under "The Labour Laws (Exemption from furnishing Returns and Maintaining Registers by Certain Establishments) Act, 1988.

First of all, please note that there is no S&E Registration Certificate under the TN Shops & Establishments Act.
But, there is a process for getting the approval in Form III - under the TN Industrial Establishments (National & Festival Holidays) Act.
That will be the permanent one, until there is a change in the holidays list...
