Dear colleagues,
Please find the Tamilnadu Shops and establishment act, 1947 manual.
Also the abstracts to be displayed in the premises, Registers / Forms and annual return to be submitted to the concerned authority.
Abstracts / registers can be got from Sitaram & Co, Royapettah.

Tamil Nadu Shops & Establishment Act
We are running a Show room with 3 staffs & 2 carpenters;
Holidays Listed for 2012 is 12 days
staffs Leave allowed 24 days/ year;
Carpenters= Along with the Holidays How many days leave can be allotted.
Kindly forward your suggestions as per the act.

Dear Nalini,
Hope it is a furniture showroom. Carpenters are on company role or contract role or daily wages.
Company Role - should treat them as other sales staffs.
Contract Role - The contractor will take care and replacement will be given on their absence.
Daily wages - just day off is enough for 6 working days. If they take leave you can deduct the salary.

Thank you sir, The Carpenter are in the contract role, but by mistake we have given confirmation....after 1 year .. Now should they be treated as company staffs. Nalini.P

Dear Nalini,
Yes. Since you would have given them Appointment letter/ Confirmation letter where you would have mentioned all the benefits which will be given to the employee. you have to abide on the same.

Pls. suggest me in Salary part.
We are Engineering Co. with 20 member team.
Staffs= 15
Operators-2
contract= 3
Others =2
We are not into any Government compliance , Because in Machinery unit we have 5 Members, Balance 17 in Office.The pay structure for staffs is
Basic &DA-40%
HRA -15%
Local conveyaance-15%
Other allowance-30%
Salary range is (Rs. 10000-40000)
Is the breakup is ok. or should we change.

Dear Nalini,
You can go for as follows
Basic + DA = 60%
HRA - 20 %
Conveyance - 10 %
Medical / other allowance - 10%.
Hope you are a growing organisation - When you are coming under ESI (Hope you are aware ESI Dept has proposed for change from minimum 20 to 10 employees which will be done in 1-3 months) & PF act you will be having only minimum employees for contribution since your salary range is between (10000 - 40000) many employees will be having a basic of above 6500/- where you can get the exemption from PF contribution or make Rs.780/- as maximum contribution.
Else
Make as
Basic - 50%
HRA - 30%
Conveyance - 10%
Medical / Special allowance - 10%
