Respected Seniors,
Kindly guide for the following situation:
Company policy is to give annual increments From April of every year to the eligible employees. Due to some reasons Increments has been delayed for 4 months. In the mean time some eligible employees were resigned from the service and relieved also. ( Their accounts also settled)
Increments were not declared and not paid till date.
In such secenario, whenever company declares the increments, whether the outgoing employees were eligible for Arrears of Increments for those months actually they worked.

Hi,
Usually, Companies do not have such policies to give increments/arrears to exited employees however, there can be some exceptions e.g.
1) If appointment/last increment letter specifically guarantees (or can be proved in that fashion) that employee will get the next increment (unconditional) then in the absence of the increment, Employee can protest and ask for the arrears.
2) Employee is protected by the Union Contract and one of the conditions bound the Company to pay the arrears, even to existed employees.

Dear Sekhar,
As per industrial practices, When increments have been declared, that is eligible to those employees are in the service.
Once employees are resigned & relieved, they are not eligible for increments even though they put the services during the arrears month.
