DEAR ALL
I am in confuse in case were notice of enquiry served to the worker and asked to give explanation with in 48hrs on finding of enquiry officer but he doent give any reply
what will be next action?

Dear Sacheein
Upholding the principles of natural justice, the Inquiry Officer, holding the inquiry proceedings, must give reasonable opportunity to the charge sheeted / delinquent employee to defend his action and / or examine his evidence / witnesses and cross examine the evidence / witnesses to be produced by management representative.
This means that if the concerned employee did not shpw up to attend the inquiry proceedings, s/he should be given yet another opportunity to attend the inquiry proceedings or inform the Inquiry Officer about his/her inability to attend the inquiry.
The Inquiry Officer must take care to sent the inquiry notice by Registered Post AD to his/her recorded home and local postal addresses and arrange to put up a copy of the notice of inquiry on the departmental notice board.
