pls refer section 4 of gratuity act.
gratuity of individual can be forfieted if services are terminated on riotous or disorderly conduct or any other act of vilence or offence involving moral trpitude or will ful ommission,neglgence causing damage or destruction of property belonging to employer.

Thank you sir for reminding me, but what about pregnant women employee, if she worked for 2 years in a firm but with out notification absconding from duty and do not want to continue work in that circumstances Gratuity is payable or not?

When an employee is not eligible for payment of gratuity then that employee will not be given gratuity payment.

Hi,
I am leaving my job after completing 5 years 1 month with offer 5 days notice period and 26 Paid Leaves deduction on my account due to urgent joining next company and join another organization with a good deal. So I want to know that - Is graduaty will paid to me at the time of Full & Final Settlement in the case where previous company not accepted my resignation and declare myself Abscond.
