Mr. xyz was in Visit Visa in Dubai and a company has given a appointment letter to him in the month of March2011, Mr. Xyz on visit visa started working in March2011 and got paid for the same on the date of Salary, as company was facing some visa issue, Mr. Xyz was not been able to get a Residence visa before his visit visa last date, so company has decided and inform to Mr. Xyz to travel to his home country and we will send you a Residence visa, as promised company has send him a Residence visa in July2011, in this case which Date to be consider as a Joining Date. March2011 or July2011.

Please explain the forum clearly. You have maintained the name confidential by terming it as "XYZ", wonderful, we appreciate it. We would like to know the following: -
Was Mr. XYZ paid during his stay at home country till the time the company sent him the Residence Visa? On what terms were this period considered. Leave, paid holiday, absent, break what???...... Was the expenses travelling to and fro borne by the company?
However, we would like to know whether do you deem that working or getting employed in a foreign nation on a visit visa is legal.
Finally: -
In anycase, the company has accepted and permitted XYZ to work in their organisation on visit visa itself. Then, that date is the exact joining date.
If the company has terminated XYZ or obtained a Resiganation from him before leaving to home country; then it should be a re-employment for XYZ, who commences his fresh tenure with the company as on new date?
Can you be a bit more clear please?
