One employee has applied for leave. There is no leave balance. We will treat it as a loss of pay. I doubt the person was leave applied from 01.11.2011 to 22.11.2011. There are 22 days and 3 Sundays (weekly offs) there. The Sundays (weekly offs) are also treated as a loss of pay in our company. What are the rules and regulations in the above matter?

The law (refer Factories Act) says after 6 th day of working or after completion of 48 hours in a week a day should be given as a weekly holiday and not a weekly holiday with wages.
Therefore when we come to your case, since the person has not worked 48 hours in a week and has taken entire week on LOP the Sundays also to be treated as LOP only

Employee is on leave Monday to Wednesday means 3 days leave to be deducted from the leave balance. Sunday is weekly off and hence no need to consider it as leave. However if the employee is on leave from Friday to Wednesday and in between weekly off should also be adjusted against leave.

In many organisations, a difference is maintained between Casual Leave and other types of leaves (like Earned Leave/Privilege Leave/Annual Leave/ Sick Leave/ Medical Leave etc) In CL, only the actual working days are counted and any intervening holiday is not included for leave purpose. In other types of leaves all intervening holidays are included but a holiday preceding or succeeding such leave is excluded.
