Hi All,
I work with a small software company having around 30+ employees. The company has a leave policy which states that only a max of 5 leaves will be encashed and any other unavailed leave will lapse.
I feel that it is unfair on employees as being a small team they end up working longer hours and most of the time their leave applications are not approved. Hence if they wish to take leave they cannot and at the end of the year they do not have the option of carrying forward the leave.
Is there any Act which states that the leave should be carried forward or encashed in full.
I would appreciate any help in this area.

Dear Sender
There is no act for encashing leave.
Applicability of leave and leave rules will vary from organisation to organisation.
For calculating unavailed leave, basic and da will be multiplied with number of leave available in employees credit.

Hi Richa,
In practice most of the companies follow an almost similar structure of Leave policy.. that if one doesn't avail his or her Paid leaves in a particular calender year then remaining leaves will be carried forward for the next calender year.
Some companies do encash those remaining leaves at the end of calender year and some do the same at the time of separation only...
Number of paid leaves which shall be carried forward differs from company to company...

Thank you for your reply. Is there any act regarding leaves which states how many leaves should be given, how many can be carried forward as a benchmark based on which companies can make their policies?

Dear Richa
Leave can be accumulated maximum for 300 days and eacashment of leave is subject to IT,. It is policy matter of the organisation and no act is available for leave availment.
