Can an employer allow PF deduction for some employees on more than 15k while restricting some others on 15k.
eg: Total 10 employees in an organization. All 10 employees PF salary is 20k but :
- for 05 selective employees, the employer is paying contribution (12%) on a minimum PF salary of 15k which is Rs 1800 per employee
- for the rest 05 employees, the employer is paying a contribution (12%) on PF salary 20k which is Rs 2400 per employee.
Will this amount to discrimination or it is the employer's prerogative to decide whom he wants to restrict on 15k or more.
Kindly spread some light on the above scenario.

Yes, an employer can do PF deduction for some employees above the slab limit of 15k and others on 15k limt on strength of the rule.
Your concern over matter is justified but our Govt framed rules inherent discrimination and the employer takes benefit of it. Thereby nothing stands at its place.
All the employees under 15K limit request employer to keep parity for all the employees.
