Hello I have completed my 8 years in a Pvt Ltd IT company. After 5 years i have taken 1 year maternity leave and then rejoined. Am I eligible for gratuity? now i resigned. CAn i claim gratuity?

you are eligible for gratuity for 8 years as your maternity leave has to be considered period of service your reckoning your eligible year of service.

As learned member Kumaracme has mentioned you are entitled for gratuity having put in more than 5 years of service at the time you leave the employment of this firm.

My Basic Pay is 16200 from 1 year, I will quit in this July. Then how much amount i will get as gratuity ? I have 8 years of service, in between i have taken 1 year maternity leave after 5.5 years. So total experience is 7 years. So how much amount I will get as gratuity? and how i need to claim gratuity ?

Dear Binduks, If service is 7 years and salary is 16200, gratuity is 16200x7x15/26 = 65,423 Abbas.P.S

Gratuity formula is Basic x 15 x no.of years / 26 days. Accordingly, you are entitled for gratuity provided this clause are clearly mentioned in your appointment letter

Dear Friend,
However, Maternity Benefit leave is not for 1 year under Maternity Benefit Act 1961.
Now, come to the point of Gratuity. You are eligible for Grauity for first 5 years. Rest of 3 years you are not eligible.
However, there is one contradiction, i.e. if your new appointment letter has mentioned the date of inception of your employment in the current organization.

What ABBASITI said is correct. provided you have continuous service of 8 years without any break including your authorised Maternity leave.
