Dear Friends,
I have a small query.
My organisation is registered under Delhi Shops and establishment act.
The company wants to open showroom tommorrow i.e. on 2nd oct, which otherwise is a national holiday.
Can you please help me with complete act, or conferm the penalty amount for opening shops on national holiday.

Thanks Mr. Peer,
True. Loads n loads of info is available on CITE HR.
And the first thing i did was to search CITEHR for my query, but it seemd that there were many who asked question similar to mine, but dint get any answers.
My whole concern as of now are sales employees. I want the penalty details for opening showroom on National holiday, so that i can convince the GM to reconsider his decision. My org is registered under Shops n Establishment Act.

As i am working in a organization which has showrooms...............we at times tend to open showrooms on national holidays......................for opening showroom u can give ur workers a compensatory off on the very next day or with in the week one by one to all employee who worked on 2 nd oct
otherwise u can also give them salary for that u hav to follow overtime formula in this case u hav to pay double amount of the per day salary..........................

Dear Ambalika,
Thanks for the practical suggestion. Actully this is exactly what we are doing. making them work tommorow and in turn giving them comp off this month itself, else encash the same with this months salry.
But my concern was to get them a holiday tommorrow, by convincing the sales head for the same, or let him know about the legalities of the matter.

If u want u cal tell ur senior about the legalties if u open your shop on Natinaol holiday nd if hav to pay three times salary of each employee who is working on that particular day.......its against labour law and labour department can take action against the comapny..

Onme should look from organisation part also. Today with all compite world we can not run the organisation with all bank holiday as mention
One should undersatand and if empoyer is ready to pay extra money to work on hoilday , we should also adjust with the same , becuase if organisation grow then only we benefits.
As otherwise we should work with public sector / goverment secotr and use all hoilday as prescribe in law.

We are talking about National Holidays which are very few in number and going by the norms we do have a prescribed set of 10 to 12 holidays in a year which is provided to every class of employee, but I must say that the indian entrepreuner tends to eat his/her way into the the employees pie in such a way that the employee tends to be the suffferer.
Most of these small time companies or start ups dont even have a proper structure in place with respect to leaves and other mandatory labour rules and regulations.

Rather then blaim indian enterprenur, please verified holiday at other contires.
Incase till us find indian enterpruner do not work, u can find job elseware then.
As regards to holiday is concern , many shops / hotel / restarunt are jam pack on holidays only it may be normal or national.
Think if you do not find hotel / chemist/ hostpital / theater and many on holiday
