Hi,
I am working into a Kolkata,WB based,Group of Company.My supervisor had misbehaved with me moreover using slang and attemtp to heat me even in a meeting with intoxicated mode.Now i want to suit a mail against these to Central Hr+Labour Dept. Moreover my company doesn\'t has the Shop & establishment registration in every branches across pan India.
Do let me know the mail id and suggestions.Or please provide any mail id so that i can directly get in touch with you.

Dear Sukanta,
Before you contact a Labour Commissioner, request you to speak to a legal expert. Any firm that operates across the nation without the registration, must have arranged for some work-around. Hence, request you to find the right information before you proceed.
Your efforts will bring result, when its well weighed against every countering clause.
Your manager's behaviour can be best rectified by either his boss or the management team at the firm. If he has continued to work with this behaviour, probably the problem runs way too deep.

and i will suggest you have some evidance give an complaint to police......
Contact with lawyer send the notice that they dnt have permission to do business.....

Please be noted that due to misbehaved and unethical approaches by the management I have left the organization in last Aug’13 after rendering more than a year in that Group of Company which is still running under ROC registration without having registration under shop and establishment act,WB.

When I left the organization I kept the Laptop which is the asset of the company with me and I have clearly mentioned in a mail to HR once my all dues(bills and reimbursement) and salary will be cleared off, the very asset will be handed over to Siliguri office(my base branch office as per Appointment Letter given by the concern HR).

But what HR has reverted on my mail that I have to visit Head Office at Kolkata for full and final settlement. Unless nothing will happened…..

My queries are as follows

1st – As it was not mentioned in the appointment letter that for full and final settlement the employee will need to sit with HR at HO only ,Kolkata so am I bound to visit at HO for Full and Final settlement?? What if I don’t visit with HO people will they take any legal action against me as per Labor act/regularities?

Secondly – if I wish to join in any other company will they accept the resignation which I put via e-mail service and not having the acceptance of the same from company's end?

Thirdly – As HR has said to visit at HO post that they will proceed further but if I don’t visit at their Head office and also don’t communicate further other than mail communication will it be harmful for my carrier? Can this case might turn into critical mode ?

Also suggest in such cases how long it can be in open ended ? I mean is there any specific ageing to close this such case ?Can I keep the Laptop with me forever?
