If one takes leave on Saturday and does not report for duty on Monday, should Sunday be considered as leave? Or it will remain weekly off. Please let me know the rule. I work in a factory governed by Factories Act 1948.

Hi, Its depend on company policies.... bt most of the companies follow this rule that sunday is include in your leave...... Meetu

In my opinion it depends upon the company policies dat whether they are considering this rule or not?? Generally good companies are not considering this kind of rule. I was working with small firm xyz where they had same rule but i don't think this is valid coz sunday is not a working day so y to include it in leave?? we have to consider Monday as his leave day.
Coz companies like Infosys are not including sat n sun as leave.....only working days are considered as leave.

Hi Garima,
If any company off on sat. and sunday of course they will not include these days as holiday, bt if anyone will take leave on friday and not come to office on monday they will include ur sat. and sundays.... as leave, most of the companies follow this rule...

Hey Meetu,
Yeah u r also correct on ur part because it totally depends upon companies policy, i already had mentioned in one example coz in my firm i had taken the leave for 8 days n reported rite on tuesday ...there was sat n sun inbetween but they included it in my leave...so this was the case with my small firm but at d same time my friend who is working with Infosys has also taken leave n reported on same day but his leaves was counted as 6...so it concludes dat generally d bigger companies following dis rule dat they are not counting weekend as ur leave day whether u are not reporting on mon.....

do not leave your policy .
if u don't like the company , then u can change your policy from one company to another company .
only convert it , don't leave it.

Tell me if an employee do not come to duty for whole month.
What salary will you pay to him?
according to me it should be "0000"
or will you pay salary of only Sunday's?
No man its not like this
this is same in case of the leave.

Hi Garima / Meetu/ Jon,
I want to know what has exactly been defined by the Factories Act, 1948. Companies make policy depending on prevailing laws. If Factories Act 1948 says, when Sat and Monday not reported for duty Sunday should be considered as leave instead of Weekly Off then the company may obey it or may voluntarily allow weekly off. But it is necessary to know what exactly the law says.

As per factory act 1948, when before weekly off & after weekly off there will be leave of any employees then,weekly off should consider as leave. But now a days most of the companies have own leave policy (Specially corporate & IT culture) i.e. weekly off is not considering as leave.

I Know dat acc. to Factory act 1948,Sat n sun should b considered as leave whn u failed to report on Mon. But there r many org. which are changing described Rule...So,its wholly n fully depends on company to company...but in my opinion this rule is justified.......
