Dear H.R.Friends,
lot of confusion is being created by in the society regarding amendment to bonus act. Some of them are of the opinion that it has come into force from 1.10.2010.
In this connection we want to clarify that so for no bill has been moved by central Govt. regarding bonus Act. However one private bill was introduced in March. 2010.

Till it is passed, no amendments to Bonus Act can be effected.

Dear friends,
the Payment of Bonus Amendment bill being circulated is a private bill. Govt has not introduced any bill regarding amendment to bonus.

I understand that this BILL has not been tabled in either house of the Parliament. However there are news reports that a Bill has been passed by Rajya Sabha and is to be passed by Lok Sabha before the President given his assent.

Dear All,

Can anyone suggest whether the 11% is in force or still pending? what is the status and effect of the Payment of Bonus (Amendment) Bill 2010 attached?

Presently we are calculating the bonus at 8.33% now. It could be very helpful if any one confirms in detail about 8.33% or 11% which will be correct to pay the current year starting from 01 Oct 2009 to 30 Sep 2010. (Tirupur, Tamilnadu)

Thanks & Regards

Dear HR Professionals

The proposal for changes are in the Bill stage. There should not be confusion in the minds of HR professionals.

As of today there is no change. If the Bill is passed by both Houses in the next session of Parliament and thereafter Presidential assent given and then notified it will change the Bonus rates.

With Regards

Sir ,

I was working with one of the 54 year old company till April2010. When I asked for my Bonus for the year 2009-2010 I was told that I am not eligible for the Bonus as my basic is above Rs.10000/- . If such is a case then how I use to get Bonus for earlier years ? Is there a clause that Bonus is not payable to employees who have resigned from services .

Please update me

Thanks & Regards

There was a proposal to amend the Act and accordingly a bill was proposed in 2010 and so far it is not approved by the Parliament. So can this be implemented ? As per our P&A dept information, it is clarified that it can be implemented only after Official Gazette is declared and until then the existing provisions are only applicable.
Can anyone confirm ?
